Eligibility

Core criteria an applicant must meet to file under this category.

  • Lawful permanent resident (LPR) for 5 years (3 years if married to and living with a US citizen the entire period)
  • Age 18 or older at filing
  • Continuous residence in the US for the qualifying period
  • Physical presence for at least half of the qualifying period (30 months of 5 years / 18 months of 3 years)
  • 3 months of residence in the state or USCIS district of filing
